Landlord fined after waste is fly-tipped

A Haverhill landlord has been ordered to pay more than £1,300 after waste from one of his properties was fly tipped near the town.

Halil Ibrahim Tuga, appeared before Bury St Edmunds magistrates on Thursday 22 October when he admitted two charges relating to breaches of care in the disposal of controlled waste.

The offences both occurred between 30 April and the 4 May this year at a commercial property 36-year-old Tuga was renovating in Camps Road.

Tuga, of Cranleigh Court, Silver Street, London, was not charged with the actual fly tipping but failed in his duty of care to not only prevent his waste being disposed of without the authorisation of an Environmental Permit, but also to ensure that he completed a transfer note for a licensed carrier of controlled waste to take away the rubbish.

An enforcement officer at St Edmundsbury Borough Council was contacted on 5 May to say rubbish including a large pile of red bricks, broken sheets of plasterboard, a green plastic crate containing cables and wood, breeze blocks and a builder’s sack containing more broken plasterboard, had all been illegally dumped at Hanchett Hall near Haverhill.

Paperwork found amongst the rubbish including letters, invoices and certificates linked the waste to a commercial property at 6 Camps Road.
Eventually the officer was able to track down the building owner and interviewed him under caution on 4 June.

Tuga said he had been working on the property during which someone offered to take the waste metal. Tuga agreed he could, providing he took away the other waste as well. He said no money changed hands and no paperwork was exchanged. Tuga admitted he was unaware there was a requirement for him to use a licensed waste carrier to take the items away. Tuga also said he had subsequently been to the site and cleared away the rubbish himself, and had apologised to the landowner.

The court order Tuga to pay costs of £637.50, £500 in fines, a £180 court charge and £30 victim surcharge.

Cllr Peter Stevens, St Edmundsbury Borough Council Cabinet Member for Operations said: “Fly tipping is a serious offence which not only impacts on the environment but also costs the local community. In England, in 2013/14 there were 852,000 incidents of fly tipping which cost local authorities £45.2 million to clear. In St Edmundsbury in 2014/15 there were 227 record incidents of fly tipping costing £29,000 to clear up. This is dirty, disgusting and where we can gather sufficient evidence we will prosecute. Fly tippers be warned.”
